Appeals, Grievances and Disputes

The most important thing to know about appeals, grievances and disputes is the difference between them:

Disputes involving the Performance Pay Program are addressed within DNR as defined in the DNR PPP Policy.  An overview of the dispute resolution process is available at the DNR PPP home page.  This page also has the form for requesting dispute resolution.  The DNR Human Resources Director decides whether the dispute falls under the Performance Pay Program.  If it doesn't, it may fall under the DNR Grievance Directive.

Grievances are disputes on matters outside the Performance Pay Program.  They generally involve one of two things:

    1.   Written corrective action.

     2.   An occurrence or action by another DNR employee, not involving corrective action.

Grievances are initially addressed to an employee's supervisor, to be resolved within DNR. If the grievant is not satisfied with the outcome, they may petition the State Personnel Board for a discretionary hearing.   Written grievances may be in memo format, or may use a grievance form.

 

It is possible to simultaneously dispute a performance evaluation and grieve an accompanying corrective action.

Appeals are resolved outside of DNR.  An appeal is a dispute of an action that adversely impacts base pay, status, or tenure. Decisions and resolution of appeals are issued by the State Personnel Board or the State Personnel Director, depending on the type of appeal.  Grievances alleging discrimination are also filed with and resolved by the State Personnel Board. 

            Both types of appeal are filed using this form, following these instructions.

  • Downward position allocation
  • Director's review of a Performance Pay Dispute
  • Director's review of application of the Personnel Rules and Procedures
  • Director's review of a matter involving the overall administration of the personnel system by an agency, which is not otherwise appealable.

  • Final Grievance Decision
  • Layoff
  • Whistleblower
  • Discrimination
